Terms of Service

The short version. Togethr gives you translated video calls and chat. The translation is done by machines, so it will sometimes be wrong — please don't lean on it for anything medical, legal, financial or safety-critical. If you subscribe, Apple takes the money and Apple gives refunds, not us. Be decent to the people you talk to; harassment, threats and abuse of children get an account closed. And if something here turns out to be unfair, the consumer rights you have under EU and Dutch law still win.

These Terms are the agreement between you and us about using Togethr. Using the app means you accept them. If you don't, that's fine — but then please don't use the app.

Who provides Togethr

Togethr is built and operated by TODO(owner), a sole trader registered in the Netherlands. Our servers run on Google Firebase in the europe-west1 region (Belgium). Video is carried by LiveKit. Transcription and translation are done by OpenAI. You can reach us at support@togethr.chat.

Apple's standard End User Licence Agreement also applies to the app itself — it's linked from the subscription screen in the app, and you can read it at apple.com/legal/internet-services/itunes/dev/stdeula. These Terms cover the service behind the app. Where the two genuinely conflict on something about the app's licence, Apple's EULA wins.

How old you have to be

You must be at least 13 to use Togethr. If you live in the European Union, you must be at least 16, unless a parent or legal guardian agrees on your behalf — some EU countries set that line lower, and if yours does, that lower age applies to you. If your country sets a higher minimum age for services like this, that higher age applies.

If we learn that an account belongs to someone under the age limit, we will close it.

Your account

You sign in with Apple, Google, or an email address and password, and you pick a @username. That username is how people find you — we never ask for or use your phone number. Keep your sign-in details to yourself; what happens on your account is your responsibility.

You can delete your account from the Profile screen in the app at any time. What that removes and what it doesn't is explained in the privacy policy.

What you may not do

Don't use Togethr to:

You can report someone from inside the app. We look at reports, and we can suspend or permanently close an account that breaks these rules — immediately and without notice if the harm is serious. If we close your account for something you didn't do, write to us and we'll look again.

Translation is machine-generated

This one matters, so it gets its own section. The captions on your calls and the translations of your messages are produced automatically by speech recognition and machine translation. They are usually good. They are not always right. They miss words, mishear names and numbers, lose sarcasm and idiom, and occasionally produce a sentence nobody said.

So: do not rely on Togethr's translation for medical, legal, financial or safety-critical decisions. Not for a diagnosis, a prescription or a dose. Not for a contract, a court matter or immigration paperwork. Not for a transaction, an investment or a loan. Not for an emergency, and not as a substitute for calling emergency services. In those situations use a qualified human interpreter. We are not responsible for what follows from a mistranslation.

Togethr is not an emergency service and cannot be used to contact one.

Subscriptions, and how refunds work

Subscriptions are sold through Apple's In-App Purchase. That means Apple charges you, Apple holds your payment details, and Apple renews the subscription. We never see your card.

A subscription renews automatically at the end of each period unless you turn renewal off at least 24 hours before it ends. You do that in your Apple account settings, not in our app — Settings → your name → Subscriptions on an iPhone or iPad, or the App Store menu on a Mac. Cancelling stops the next charge; you keep what you've paid for until the period runs out.

Refunds are Apple's to give, not ours. We cannot issue one, reverse a charge, or see your payment method. Ask Apple at reportaproblem.apple.com. If you're an EU consumer, your statutory withdrawal rights still apply and Apple, as the seller, handles those too. We'll help you work out what to ask for — mail support@togethr.chat — but the money goes back through Apple.

Prices can change. If a price goes up, Apple asks you to agree before the next renewal, and if you don't, the subscription simply ends.

Guests

One subscriber can invite up to five guests. Guests use Togethr free, on the subscriber's plan, and their calls draw on the subscriber's minutes.

If you're the subscriber: you choose who gets an invitation, so you're responsible for who is on your plan and for the minutes they use. Guests are separately bound by these Terms in their own right, and we can act against a guest's account for breaking them. You can remove a guest at any time: the Invite screen lists the people on your plan, each with a Remove button, and confirming frees the place immediately. A removed guest loses the paid features but keeps their account and their message history, and we don't notify them that it happened. You're free to invite them back with the same code.

If your subscription lapses, your guests lose the paid features at the same time you do.

Availability

We try to keep Togethr up, and we don't promise it always will be. There's no uptime guarantee here. The service can go down for maintenance, because a provider we depend on has gone down, or because something broke. Features can change or be removed. We may stop offering Togethr altogether — if we do, we'll give as much notice as we reasonably can, and we won't leave a paid subscription period unaccounted for.

Calls need a decent internet connection at both ends. Quality is not something we can promise.

What we're liable for

Nothing in this section takes away rights you have as a consumer that can't be signed away.

Beyond those, Togethr is provided as it is. To the extent the law allows, we are not liable for indirect or consequential loss, lost profits, lost data, or loss caused by a mistranslation, a call that failed, a message that didn't arrive, or a provider outage. Where we are liable, our total liability is limited to what you paid us for Togethr in the twelve months before the problem — and since Apple collects that money, it's the amount Apple passed on for your subscription.

We don't limit liability for our own intent or gross negligence, for death or personal injury caused by us, or for anything else the law doesn't let us limit.

What people say to each other on Togethr is theirs, not ours. We don't monitor conversations, and we can't — we don't store call audio at all. We're not responsible for what another user says or does to you, though we will act on a report.

Which law applies

Dutch law governs these Terms, and disputes go to the competent courts in the Netherlands.

If you're a consumer in the EU, this doesn't cost you anything: you keep the protection of the mandatory consumer law of the country you live in, and you can bring a claim in your own country's courts. Nothing here overrides that. If you'd rather not go to court, you can take a complaint to the consumer authority in your country, or to an approved alternative dispute resolution body there. Either way, your statutory rights stay exactly as they are.

Changes to these Terms

We'll update these Terms when the service changes. Small corrections get posted here with a new "last updated" date. If a change materially affects your rights — pricing structure, how guests work, what we can do with your data — we'll tell you in the app and by email to the address on your account at least 30 days before it takes effect.

If you don't like a change, stop using Togethr and cancel through Apple before it takes effect. Carrying on using the app after that date means you accept the new version.

Odds and ends

If one part of these Terms turns out to be unenforceable, the rest still stands. Not enforcing something straight away doesn't mean we've given it up. You can't transfer this agreement to someone else; we may transfer it if the business is sold, and we'd tell you first.
